DUI is a serious offense and comes with heavy penalties, even for the first-time offender.

DUI crimes include being in actual physical control of a vehicle while under the influence of alcohol, marijuana and/or drugs. DUI crimes also include being in actual physical control of a vehicle while having an amount of alcohol or prohibited substance in excess of certain parameters in your blood, breath or urine.

DUI First Offense

If you are convicted of, or plead guilty/no contest to a DUI Offense that is treated as a first offense the previous seven (7) years, you MUST be sentenced to: (1) a minimum of 2 days in jail or not less than 48 hours but not more than 96 hours of community service indistinctive garb to a maximum of 6 months in jail; a fine of not less than $400 and not more than $1,000; (2) successful completion and payment of an approved educational course on the abuse of alcohol and controlled substances; (3) pay and attend at your own expense a meeting of a panel of persons who have been injured or had members of their families or close friends injured or killed by persons driving under the influence of an intoxicating liquor or a controlled substance in order to understand the effect such a crime has on other persons; and (4) a 90 day revocation of your driver’s license by the Department of Motor Vehicles.

DUI Second Offense

If you are convicted of, or plead guilty/no contest to a DUI Offense that is treated as a second offense the previous seven (7) years, you MUST be sentenced to: At least 10 days in jail but not more than 6 months, a fine of not less than $750 and no more than $1000; pay and attend at my expense a meeting of a panel of persons who have been injured or had members of their families or close friends injured or killed by persons driving under the influence of an intoxicating liquor or a controlled substance in order to understand the effect such a crime has on other persons and revocation of your driver’s license for a period of one year by the Department of Motor Vehicles;

DUI Third Offense

If you are convicted of, or plead guilty/no contest to a DUI Offense that is treated as a third offense the previous seven (7) years, you MUST be sentenced to – not less than 1 year nor more than 6 years in Nevada State Prison; a fine of not less than $2,000 and not more than $5,000; and revocation of your driver’s license for a period of 3 years by the Department of Motor Vehicles.
